2. Our Services

FlashApps provides custom development services including:

3. User Responsibilities

When using FlashApps services, you agree to:

4. Intellectual Property Rights

Client IP: Any custom-developed solutions, code, designs, and intellectual property created specifically for you as part of our engagement become your property upon full payment. You receive full ownership and licensing rights.

FlashApps IP: We retain ownership of all pre-existing code, frameworks, libraries, tools, methodologies, and know-how used in your project. You may use these as part of the delivered solution.

Third-Party Content: You are responsible for obtaining necessary licenses for any third-party libraries, assets, or services integrated into your application.

5. Payment Terms

Payment terms will be agreed upon in individual project agreements. Generally:

• •A deposit may be required at project initiation
• •Progress payments may be due upon completion of milestones
• •Final payment is due upon project completion
• •Late payments may incur additional charges as specified in the contract

6. Limitation of Liability

To the maximum extent permitted by law, FlashApps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business interruption, arising out of or in connection with your use of our services, even if we have been advised of the possibility of such damages.

7. Warranty Disclaimer

Our services are provided on an "as-is" basis. We make no warranties, express or implied, regarding the services or any deliverables. We do not warrant that the services will be error-free, uninterrupted, or secure. We also do not warrant the accuracy, completeness, or usefulness of any information provided.

8. Confidentiality

Both parties agree to maintain the confidentiality of sensitive information shared during our engagement. This includes project specifications, technical details, business information, and any other proprietary data. This obligation survives termination of our engagement.

9. Support and Maintenance

Support and maintenance services are optional and will be separately contracted. Unless otherwise agreed, we provide limited support during the initial project phase only. Ongoing support, bug fixes, and feature enhancements are subject to separate agreements and fees.

10. Termination

Either party may terminate engagement by providing written notice. In case of termination, payment for work completed to date is still due. Intellectual property rights for completed work transfer upon payment.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our services constitutes acceptance of the updated Terms.
